TERMS AND CONDITIONS
Translations are provided for convenience. If there is any conflict, the Spanish version prevails.
These Terms and Conditions (the “Terms”) govern access to and use of APBTPedigree.com, its pages, databases, profiles, certificates, forums, messaging, claim tools, marketplace, subscription services, and any related features (together, the “Platform”).
By creating an account, clicking “accept”, purchasing a subscription, posting content, registering or claiming a pedigree, requesting a verification, or using the Platform, you represent that you have read and agree to these Terms and the Privacy Policy. If you do not agree, do not use the Platform.
1. Operator and international scope
Operator. APBTPedigree.com and the persons or entities responsible for administering the site are referred to in these Terms as “APBTPedigree”, “we”, or “our”. Users may contact the operator through the support tools available on the Platform.
International scope. The Platform may be used from different countries. The user is responsible for complying with applicable laws, including those relating to animal welfare, sale, transport, import, export, health, vaccination, identification, and animal ownership.
Languages. We may offer translations. In case of conflict, the Spanish version prevails, unless a mandatory rule provides otherwise.
2. Essential definitions
Pedigree. A digital genealogical record containing information provided by users, breeders, owners, public sources, or administrators.
Certification or verification. An internal process that reviews certain identity and/or genealogy evidence. It is not equivalent to a genetic test, government registry, or an absolute guarantee of breed purity, health, legal ownership, or reproductive fitness, unless expressly stated otherwise.
User Content. Data, text, photographs, videos, documents, comments, messages, listings, kennel names, results, links, and other material uploaded or communicated by a user.
Marketplace. A listings space that facilitates contact between independent buyers and sellers of dogs, stud services, accessories, or other permitted items.
Subscription. Paid access, recurring or for a set term, to the features indicated in the applicable plan.
3. Eligibility, accounts, and security
You must be at least eighteen (18) years old and legally able to contract. If you use the Platform on behalf of a kennel, company, or organization, you represent that you are authorized to bind it.
Registration information must be true, current, and complete. You may not impersonate another person, create misleading accounts, sell or transfer accounts, evade suspensions, or use someone else’s credentials.
You must protect your password and devices. Notify us immediately of any unauthorized access. Except as limited by law, you are responsible for activity from your account when it results from your action, omission, or lack of care.
We may request verification of identity, ownership, or representation, reject usernames, consolidate duplicate accounts, and limit features to prevent fraud or protect the community.
4. Pedigree database
The Platform allows users to search, register, manage, link, and share genealogical information of the American Pit Bull Terrier (APBT), including registered and call names, titles, sex, color, breeder, owner, weight, date of birth, registration number, photographs, videos, offspring, siblings, and ancestors.
Anyone who creates or edits a record represents, under their own responsibility, that they have a reasonable basis and the necessary permissions to do so; that the information is accurate to the best of their knowledge; and that they are not deliberately concealing material facts.
Records may contain historical errors, duplicates, aliases, translations, or disputed information. APBTPedigree may correct, merge, block, annotate, restore, or delete records and keep a change history when needed for database integrity.
The appearance of a dog, breeder, or owner in the database is not a recommendation, affiliation, recognition of ownership, kennel-club homologation, or a guarantee of authenticity.
5. Claims and ownership disputes
The claim tool lets you request control of a pedigree without an account holder and dispute the assignment of an existing record. A request does not by itself transfer legal ownership of the animal or rights against third parties.
We may ask for documents, photographs, videos, transfer history, communications, or other evidence; contact the parties; suspend edits; and decide administratively who controls the record on the Platform. That decision only organizes the service and does not replace a judgment, contract, official registry, or agreement between the parties.
Submitting false, altered, or unlawfully obtained evidence may result in rejection, suspension, content removal, and a report to competent authorities.
6. Certification and verified pedigree
The user may request identity and pedigree review through photographs, videos, documents, and other items indicated in the process. Material must be authentic, recent, legible, and of the same dog.
A badge, percentage, seal, or certificate reflects only the scope and result of the review performed with the evidence available at that time. It does not guarantee DNA, health, temperament, fertility, absence of hereditary disease, economic value, performance, legal compliance, or the future identity of the holder.
APBTPedigree may deny, revoke, correct, or re-examine a verification if new data, inconsistencies, fraud, technical error, a well-founded dispute, or non-compliance appear. Certificates may not be altered, forged, sold separately, reused for another dog, or presented in a misleading way.
The digital certificate and seal remain protected elements of APBTPedigree. A limited license is granted to download and display them only in connection with the verified dog and without altering their content.
7. Marketplace: nature of the Platform
APBTPedigree provides a space to publish and discover listings and to contact sellers. Unless expressly stated in one of our own listings, APBTPedigree is not a seller, buyer, breeder, broker, carrier, veterinarian, custodian, insurer, or a party to the contract between users.
Users negotiate price, reservation, deposit, payment method, inspection, contract, delivery, transport, documentation, warranties, and returns directly. APBTPedigree does not necessarily receive the purchase money and does not control the quality, existence, legality, or delivery of the advertised animal or item.
Metrics for views, favorites, featured listings, and search results are not an endorsement. A “verified pedigree” label refers only to the verification scope indicated on the Platform and does not automatically verify the seller or the full offer.
8. Seller obligations
The seller must have the right to offer the animal, service, or item; describe it clearly, truthfully, and without deception; disclose price, currency, location, conditions, additional costs, and availability; and keep the listing up to date.
In animal listings, the seller must in good faith disclose age, sex, breed, identity, pedigree status, known health, vaccination, deworming, microchip if any, reproductive restrictions, and any material condition. The seller may not use photos of another animal or conceal disease, defects, or ownership disputes.
The seller is responsible for contracts, invoices, permits, health certificates, veterinary checks, taxes, export/import, safe transport, and compliance with the laws of their country and of the destination.
Listings of stolen animals, animals obtained unlawfully, sick animals offered fraudulently, animals intended for fighting, abuse, abandonment, illegal experimentation, or any activity that compromises their welfare are prohibited.
9. Buyer obligations
The buyer must perform independent diligence before paying: verify the seller’s identity, see the animal in real time when possible, review original documents, confirm veterinary history and pedigree, investigate legal restrictions, and use a written contract.
Do not send deposits by irreversible methods to unknown parties without sufficient verification. The buyer assumes the decision to contract and must arrange transport, receipt, permits, quarantine, registration, and veterinary care.
Purchase disputes must first be resolved between buyer and seller. APBTPedigree may share information or moderate access, but is not required to refund payments made directly to third parties.
10. Subscriptions, payments, and renewal
Applicable features, price, currency, taxes, period, deadline, and payment window will be shown before you subscribe. Processing may be handled through PayPal or another external provider, also subject to their terms and policies.
When the plan is recurring, the user authorizes the charges and renewals clearly disclosed at purchase. Future renewals may be cancelled from the account or through the indicated channel, but access continues until the end of the paid period unless another condition is communicated.
Payments are non-refundable once the period has started or the service has been consumed, except where mandatory law, the plan description, or a published policy requires otherwise. Duplicate charges, technical errors, or undelivered services may be reviewed if claimed within thirty (30) days.
Non-payment, unjustified chargeback, reversal, or expiration may limit forum, messaging, support, or other subscription-linked features. Legal rights that cannot be waived will not be removed.
We may change prices or benefits for future periods with reasonable notice. The change will not affect an already paid period except with the user’s acceptance or as required by law.
11. Forum, messaging, and support
The forum, user-to-user messaging, and support chat must be used lawfully and respectfully. Private messages should not be treated as absolutely confidential: they may be processed, retained, or reviewed when necessary to provide the service, investigate reports, prevent fraud, protect safety, or comply with law, in accordance with the Privacy Policy.
Threats, harassment, hate, defamation, pornography, child exploitation, fighting or animal-cruelty content, doxing, spam, malware, scams, reputation manipulation, illegal sales, and publication of other people’s personal data without authorization are prohibited.
Moderators and administrators may edit titles, move, close, hide, or delete topics and posts; block users; remove files; and retain evidence of violations. We do not assume a general duty to monitor all content before it is published.
12. User Content and license
You retain the rights you hold in your User Content. By uploading it, you grant APBTPedigree a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, technically adapt, translate, display, distribute, and communicate that content to the extent necessary to operate, improve, promote, and protect the Platform.
The license over public content may continue while the material is a legitimate part of genealogical records, shared copies, histories, certificates, or backups, even after the account is closed, when deletion would affect database integrity or third-party rights. This does not limit deletion rights that apply by law.
You warrant that you own or control the necessary rights and consents, including those relating to photographs, videos, trademarks, names, personal data, and documents. You will not upload material that infringes privacy, intellectual property, confidentiality, or other rights.
13. APBTPedigree intellectual property
The software, design, structure, databases, compilation, original texts, graphics, logos, seals, certificates, badges, trademarks, and other Platform elements belong to APBTPedigree or its licensors.
A personal, limited, revocable, non-exclusive, and non-transferable license is granted to use the Platform in accordance with these Terms. Mass copying, scraping, mining, reselling, sublicensing, creating parallel databases, circumventing controls, using unauthorized robots, reverse engineering, or using marks and seals in a way that suggests affiliation is prohibited.
Search engines may index public pages according to our technical instructions. Any additional automated use requires written authorization.
14. Prohibited conduct
In addition to other prohibitions, you may not: enter false data; manipulate genealogies; duplicate dogs to deceive; forge certificates; claim other people’s records; interfere with the service; test vulnerabilities without permission; extract personal data; evade payments; buy reviews or favorites; send unsolicited advertising; or use the Platform to facilitate dog fighting, cruelty, illegal gambling, animal trafficking, or other unlawful activity.
Historical reference to titles, colors, results, or names present in old records does not authorize or promote illegal activity or abuse. APBTPedigree expressly rejects animal fighting and may cooperate with authorities when there is a legal basis.
15. Moderation, suspension, and closure
We may warn, restrict, deprioritize, suspend, or close accounts; remove content; cancel listings; revoke certificates; and limit IP addresses or devices in cases of non-compliance, risk, fraud, legal requirement, non-payment, or a threat to the integrity of the service.
When reasonable, we will notify the reason and offer a review channel. We may act without prior notice in cases of urgency, risk of harm, preservation of evidence, or legal prohibition.
The user may close their account. Closure does not eliminate pending obligations, transactions with third parties, necessary histories, legitimate public records, or content we must keep by law, for security, to defend claims, or for genealogical integrity.
16. Privacy and personal data
The processing of personal data is described in a separate Privacy Policy that should be published together with these Terms. We may process account, contact, activity, content, limited payment, device, communication, and verification-evidence data to provide, secure, and improve the service.
Users must not publish identity documents, private addresses, financial data, veterinary records with personal data, or other sensitive information in public areas. If you include third-party data, you represent that you have a sufficient legal basis or consent.
Requests for access, rectification, update, objection, portability, or erasure may be sent through the Platform’s support tools. They will be subject to identity verification, applicable law, and exceptions needed to preserve rights, security, and database integrity.
17. Third-party services and links
The Platform may integrate PayPal, hosting, messaging, maps, analytics, social networks, storage, or other providers. APBTPedigree does not control their systems, terms, availability, or independent data processing.
Sellers’ links, phone numbers, and WhatsApp accounts are offered for convenience. Accessing or contracting with third parties is the user’s decision and responsibility.
18. Availability, changes, and backups
The Platform is offered on a continuous basis with reasonable availability, but it may suffer maintenance, errors, attacks, third-party failures, loss of connectivity, or technical changes. We do not guarantee uninterrupted operation or perpetual retention of every file.
We may add, modify, or remove features, categories, plans, and limits. If a change materially reduces a paid service during the contracted period, we will apply the remedy required by law or a reasonable commercial alternative.
The user must keep copies of contracts, certificates, photographs, receipts, and essential data. Do not use the Platform as the only archive of critical information.
19. Disclaimers
To the maximum extent permitted by law, the Platform and its content are provided “as is” and “as available”. APBTPedigree does not guarantee absolute accuracy of pedigrees, identity, or ownership; absence of errors; commercial results; genetic compatibility; animal health or behavior; or the truthfulness of users and listings.
Genealogical, community, or certification information does not replace veterinary, genetic, legal, tax, customs, or professional advice. Before breeding, buying, selling, transporting, or treating an animal, consult competent professionals.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be limited.
20. Limitation of liability
To the maximum extent permitted by law, APBTPedigree will not be liable for indirect, incidental, special, or punitive damages, or for loss of profits, reputation, opportunities, data, or an animal’s value arising from use of the Platform, relationships between users, or reliance on third-party content.
Where legally admissible, APBTPedigree’s total aggregate liability for claims related to the Platform will not exceed the greater of: (a) the amount paid directly to APBTPedigree by the user during the twelve (12) months before the event; or (b) one hundred United States dollars (USD 100).
These limitations will not apply to willful misconduct, gross negligence, attributable injury or death, intentional rights violations, or other liabilities that the law prohibits excluding or limiting.
21. Indemnity
To the extent permitted by law, you will defend and indemnify APBTPedigree, its owners, affiliates, administrators, and collaborators against third-party claims arising from your content, listings, transactions, treatment of animals, legal non-compliance, infringement of rights, or violation of these Terms. This obligation does not cover damages caused exclusively by unlawful conduct of APBTPedigree.
22. Notices and reports
Operational communications may be sent to the email, account, or interface of the Platform. The user must keep contact details up to date.
To report fraud, animal cruelty, intellectual-property infringement, impersonation, unlawful content, or a pedigree dispute, use the Platform’s reporting or support tools, identifying the URL, the facts, available evidence, and your contact details.
We may retain and disclose information when there is consent, a legal obligation, a valid order, or a reasonable need to protect rights, safety, animals, users, or the Platform, in accordance with the Privacy Policy.
23. Governing law and dispute resolution
These Terms will be interpreted in accordance with the laws applicable to the operator, the user, and the service in each case. No clause is intended to eliminate mandatory consumer, privacy, e-commerce, animal-welfare, or access-to-justice rights recognized in the corresponding country or region.
Before starting a formal claim, the parties will try to resolve the dispute through written communication via Platform support and good-faith negotiation for thirty (30) days. This does not prevent seeking urgent measures, reporting to competent authorities, or exercising rights that cannot legally be limited.
Where the law allows a forum to be chosen, any dispute will be brought before the competent courts of the place where the operator is established. Consumers will retain the right to go to the courts or protection bodies that are mandatorily competent in their place of residence.
24. Changes to the Terms
We may update these Terms for legal, technical, or commercial changes. We will publish the new version and its effective date. If the change is material, we will give reasonable notice by email or inside the account when appropriate.
Continued use after the new version takes effect constitutes acceptance, unless the law requires additional consent. If you do not accept, you must stop using the Platform and cancel future renewals.
25. General provisions
If a clause is invalid, it will be adjusted to the minimum necessary and the rest will remain in force. Failure to exercise a right is not a waiver. The user may not assign these Terms without authorization; APBTPedigree may assign them as part of a reorganization, sale, or transfer of the service, respecting applicable rights.
These Terms, the Privacy Policy, the plan conditions, and published specific rules constitute the agreement applicable to use of the Platform. In case of conflict, the specific conditions of a service will prevail with respect to that service.
Sections on intellectual property, licenses, outstanding payments, liability, indemnity, disputes, and data retention will survive account closure when their nature so requires.
Annex A. Minimum rules for animal listings
- Identity
- Current photographs of the animal offered; a coherent name or identification; a correct link to the pedigree if included.
- Information
- Price and currency; location; age or date of birth; sex; known health condition; vaccines; delivery or shipping; restrictions and costs.
- Transparency
- State whether the pedigree is verified or not, and do not confuse a pedigree verification with a veterinary or genetic guarantee.
- Welfare
- Safe delivery, legal age, adequate care, and compliance with health and transport rules.
- Prohibitions
- Stolen animals, false identities, photos of other animals, false documents, fighting, abuse, exploitation, fraud, or prohibited species or items.
These Terms are drafted for an international platform. Mandatory rules of each user’s country or region will continue to apply where relevant.
